Privacy Policy
SoulSensei (the “Platform”) is a digital platform for users to connect with and learn from leaders (the “Leaders”). The Platform is developed and operated by RNJP Technologies Private Limited (“RNJP Technologies”) having its registered office at Office 2, 22, Paradise Villa Comp., Bhulabhai Road, Cumballa Hill, Mumbai - 400026. The users accessing and using the Platform will be collectively referred to as the “Users” and individually as the “User”. This Privacy Policy (“Privacy Policy”) sets out the basis on which any personally identifiable information that RNJP Technologies may collect from a User, or that a User may provide to RNJP Technologies, will be stored, processed, used, preserved and/or shared with other Users and/or third parties, and constitute a contract between RNJP Technologies and the User. Upon accessing and prior to registering, using and availing any service offered by the Platform, the User must carefully read, understand, accept and agree to be bound by this Privacy Policy, the Terms of Use [available at https://soulsensei.in/terms-and-conditions], and any other terms that may be published on the Platform (the "Terms").
1. Information Collected
RNJP Technologies will collect the following information (“User Information”):
1.1. Information Provided by the Users: To sign up on the Platform and to register for courses offered on the Platform (the “Courses”) and/or to access and use the Platform, a User will provide personal information, including but not limited to name, phone number, email address, and other relevant information. A User may also be asked about its feelings, interests and other general information.
1.2. User Inputs: A User may share comments, messages, and questions on the Platform for their Leaders, which may contain personal information.
1.3. Device and Usage Information: The Platform may collect information about the User’s device, including device type, operating system, unique device identifiers, and mobile network information. The Platform may collect certain information when a User uses the Platform, including IP address, browser type, referring/exit pages, and the dates and times of interactions with the Platform.
2. Purpose and Usage of Information
The Platform and RNJP Technologies will use the information collected for the following purposes:
2.1. To Provide Access to Courses: The Platform and RNJP Technologies may use User Information to provide the Users with access to the Courses. The Platform and RNJP Technologies uses User Information to enable wider and enhanced interactions between the Users and their Leaders through the Platform and other modes including, email, text messages, WhatsApp, Zoom and other third party communication applications.
2.2. To Communicate and Share Information with the Users: The Platform and RNJP Technologies may use User Information to send automated messages to the Users for various purposes including sharing Course content, information, notes (if any), links to join/attend the Courses, WhatsApp groups/communities, and/or to access and/or download third party applications; appreciation messages for completing a Course. The Platform and RNJP Technologies may also send messages on WhatsApp, text messages, emails or push notifications to the Users to provide updates about the Platform.
2.3. To Improve the Platform: RNJP Technologies may use User Information to improve the Platform’s features and functionality and RNJP Technologies’ offerings and services.
3. Disclosure of Information
The Platform and/or RNJP Technologies may share User Information in the following circumstances:
3.1. Service Providers: The Platform and/or RNJP Technologies may share User Information with service providers engaged by RNJP Technologies to perform various business services including administration, technical support, customer care, research and analysis, marketing, monitoring, measuring and assessing the Users’ preferences and trends.
3.2. Leaders: RNJP Technologies may share the User Information with the Leaders to widen and enhance interactions with their Users.
3.3. Legal Compliance: The Platform and RNJP Technologies may disclose User Information if it is under a duty to disclose or share such User Information in order to comply with any order or legal obligation, under any law, or in order to enforce or apply the Terms. This includes disclosing information to government agencies, other companies and organizations for the purposes of prevention, detection and investigation of fraud including cyber related crimes.
3.4. Affiliates: If RNJP Technologies merges with another business entity or gets acquired or enters into any other corporate restructuring, RNJP Technologies may disclose or the other entity may acquire some or all of User Information as collected in accordance with the Terms. Such merger or acquisition or corporate restructuring may result in the modification of the Privacy Policy.
4. Consent
4.1. The Users, by the act of registering for a Course or by registering in any manner with the Platform, expressly provide consent and grant permission to the Platform and RNJP Technologies and/or its representatives: (i) to use, collect and process User Information, as submitted and collected in accordance with the Terms and in the manner and for the purposes as provided under the Terms; and (ii) to share, disclose and/or transfer User Information, as submitted and collected in accordance with the Terms, with any third party.
4.2. RNJP Technologies reserves the right to make changes to the Privacy Policy without any reference to the Users. The User’s continued use of the Platform after being notified of the changes to the Privacy Policy will constitute the User’s consent and acceptance of such updated terms of the Privacy Policy. The User represents that the information submitted by the User to RNJP Technologies is in all respects complete, accurate and true. The User is solely responsible for the authenticity and correctness of its User Information.
4.3. The Platform is not intended for use by children i.e. persons under the age of 18 years. The Platform and RNJP Technologies does not collect any personal information from children.
5. Your Choices
5.1. The Platform and RNJP Technologies uses cookies and similar tools, files or technologies to track the User’s use of the Platform. The User acknowledges that the User's browser may be set to automatically allow cookies. The User may disable some (but not all) cookies through the browser settings on the User’s electronic device but doing so may limit the User’s ability to use some features or functionalities of the Platform.
5.2. By accessing the Platform, the User accepts and agrees to the Platform and RNJP Technologies’ use of cookies and/or any third party’s use of cookies on the Platform, in accordance with this Privacy Policy.
6. Security
6.1. The Platform and RNJP Technologies follows generally and commercially accepted, appropriate electronic, and managerial procedures to safeguard and help prevent unauthorized access to User Information, as submitted and collected in accordance with the Terms and to maintain data security. These safeguards take into account the sensitivity of the information that the Platform collects, processes and stores and the current state of technology. The Platform and RNJP Technologies’ security measures may be reviewed and updated in terms of technological advances. The Platform and/or RNJP Technologies assumes no liability or responsibility for disclosure or leak of any User’s Information due to errors in transmission, unauthorized third-party access, or other causes beyond the Platform and RNJP Technologies’ control.
6.2. Notwithstanding anything contained in the Privacy Policy or elsewhere, the Platform and/or RNJP Technologies will not be held responsible for any loss, damage or misuse of User Information, as collected in accordance with the Terms, if such loss, damage or misuse is attributable to negligence on part of the User, or on part of any third-party or a force majeure event.
7. Rights Of the Users
The User is entitled to the following rights in relation to its User Information:
7.1. Right to confirmation and access: The User is entitled to obtain information and/or confirmation, with respect to the processing of its User Information, collected in accordance with the Terms.
7.2. Right to correction: The User is responsible to notify the Platform of any inaccuracy in the User Information provided by the User under the Terms and seek correction of such information.
7.3. Right to be forgotten: The User is entitled to restrict or prevent the continuing collection, processing, usage and disclosure of User Information to and by the Platform and/or RNJP Technologies.
7.4. Right to grievance redressal: The User can raise its grievances in connection with the use of the Platform by itself and/or any other User. The Platform will redress such grievances in accordance with this Privacy Policy and applicable laws.
7.5. Right to nominate: The User is entitled to nominate any other individual to exercise the User’s rights in case of death or incapacity of such User. These rights can be enforced by the User by addressing an email to the grievance officer in the manner as provided under the grievance redressal mechanism of this Privacy Policy.
8. Governing Law & Dispute Resolution
The Terms will be governed by the laws of India. Any dispute or difference arising between RNJP Technologies and the Leader in relation to any matter connected with the terms of the Terms will be referred for adjudication before a single/sole Arbitrator, who will be mutually appointed by the parties. Failing such mutual agreement over the choice of Arbitrator, the parties will appoint the Arbitrator by taking recourse to the procedure provided under the Arbitration and Conciliation Act, 1996. The Arbitration proceedings will be conducted as per the provisions of the Arbitration and Conciliation Act, 1996. The substantial laws of India will be applicable. The venue for arbitration will be Mumbai and the language of the arbitration will be English. The costs of arbitration, save and except the cost of advocates/counsels of respective parties, will be shared by the parties in equal proportion. The award passed by the Arbitrator will be final and binding upon the parties. Subject to provisions relating to arbitration, the courts of law at Mumbai will have exclusive jurisdiction to entertain, try and determine any matter that may arise hereunder.
9. Miscellaneous
9.1. The Users and RNJP Technologies agree that the performance of the mutual obligations and promises undertaken by the Users and RNJP Technologies under this Privacy Policy are adequate/sufficient consideration for the purposes of this Privacy Policy and the validity, effectiveness and subsistence of the provisions of this Privacy Policy will not be challenged for want of monetary consideration.
9.2. The failure by either party to enforce any provision of this Privacy Policy or to avail any remedy available to it in law or under this Privacy Policy will not constitute a waiver of the right by such party to enforce such provision of this Privacy Policy or to avail such remedy.
9.3. If any provision of this Privacy Policy is held to be invalid or unenforceable by any court of competent jurisdiction or is rendered invalid or unenforceable on account of coming into force of any law, the remaining provisions of this Privacy Policy will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law.
9.4. The relationship between the parties will be on a principal-to-principal basis and nothing in this Privacy Policy is intended to or should be construed to create a partnership, association of person, joint venture, agency or employer-employee relationship.
9.5. The Users will not be entitled to assign this Privacy Policy or any part thereof without the prior written consent of RNJP Technologies. RNJP Technologies will be entitled to assign this Privacy Policy to a third party, in whole or in part.
9.6. All notices required or permitted under this Privacy Policy will be in writing and delivered by email, registered mail, postage prepaid with return receipt requested, and in each instance, will be deemed given upon receipt. All communications to RNJP Technologies will be addressed to the grievance officer. All communications to the User will be addressed to the email address provided by the User at the time of registration with the Platform.
9.7. RNJP Technologies will not be responsible for any failure or delay in RNJP Technologies’ performance under this Privacy Policy, for reasons beyond RNJP Technologies’ reasonable control, including, but not limited to, penetration events such as hacking, malware, etc., disconnection by internet providers, internet outage, server breakdowns, server downtime, system incompatibility, strikes, labour disputes, lockouts, war, acts of terror, riot, acts of God, epidemics, pandemics, or governmental action and / or restrictions.
9.8. The Terms constitute the entire agreement between the Users and RNJP Technologies and supersedes all prior agreements, arrangements and understandings, whether oral or written, between the Users and RNJP Technologies in relation to the matters dealt with herein. No amendment, modification waiver of any provision contained in the Terms or any alteration to the Terms will be considered valid and/or effective unless such amendment, modification waiver of any provision contained in the Terms or any alteration to the Terms is made in writing and signed by both parties and/or their duly authorised representatives.
10. Grievance Redressal
You may address requests/grievances and / or complaints to support@soulsensei.in . RNJP is available to address grievances between 11:00 A.M. to 5:00 P.M. from Monday to Friday except public holidays. RNJP Technologies will endeavour to respond to the User’s grievances within a period of 24 hours from the receipt of the email and resolve the grievances within a period of 15 days from the receipt of the email.

11. Effective Date
The Privacy Policy and any amendments thereto will be effective from the date the Privacy Policy were last published.
